Yeah, this kind of stuff sucks. I know that if I plan to use a costume photo for reference in my art, I message the person who shot it. Like the art in my profile pic, that is a JC photo. I checked with him and he was cool with it so I proceeded. Some artists and shady sellers don’t care at all, they will just take and sell without hesitation.
I’d reach out to the seller and let him know it’s copyright infringement, I already did and he blocked me

I reported and all that happened was Facebook made it where it won’t show up on my timeline
This disgusts me!!! Someone is basically making money from stealing from a member!!

I’ve had my images show up on more than a few things and I can relate to the frustration.
However, no one is looking at this realistically. You know why this keeps happening? Because none of us will, or really can, do anything. The only way to put a stop to something like this is to take legal action. And let’s face it, none of us here can afford to hire lawyers to go after these people. And even if you did, I doubt any of us would have much of a case, because regardless of whether they’re our pictures being used and sold…they depict a licensed character, which NONE of us own. No one would have a case, except Miramax, Trancas, etc. That’s why we all get ignored and blocked, because they know all of this, I’m sure. We’re not a threat to these people, unfortunately.

The way I see it, I have no place to assume if either J or Si have the money to pay for a lawyer, but I think you’re right about the photos depicting a character owned by Trancas, Miramax etc…
If they’re the ones with real leeway in this, why not report that company to them for selling these posters with their character on it?

This stuff pisses me off. I commented on the fb post saying that it’s a stolen image, and i also reported the post. If that’ll help much, I’m not sure, but i couldn’t sit back and not do or say something. It’s total BS. I just found out that some lady used a picture of my artwork to make greeting cards with. It wasn’t a huge operation by any means, but still. Stealing/using artwork without the artists permission is wrong

Pisses me off big time but if we look at it, indie artists basically make money off a character that they didn’t create. It’s still different but kinda the same principle. The difference is artist don’t take original Kirk masks and put another title and sell them like they created it.
I sent them a cease and desist email.
They asked for some more information but hopefully they will take them all down soon.

I don’t really want profit. Just a hobby for me. But from what I’ve researched if you take a photo that photo belongs to you.
I’ve also had people writing me back on FB saying they aren’t mailing them and they are super low quality so… yeah.
Copyright is a property right. Under the Federal Copyright Act of 1976, photographs are protected by copyright from the moment of creation. … The subject of the photograph generally has nothing to do with the ownership of the copyright in the photograph.
Just saying whatever has been sold should be shared with you but I hope it gets pulled soon. Bad circumstances but amazing shot!
