Licensing?

I’ve wondered for awhile…

How does licensing work?

I see there are at least 2 “licensed” Art the Clown masks from Terrifier;

TOTS has the license to several Myers, but other companies can make other Michael Myers stuff, just not masks? (NECA figure, etc.)

But TOTS cant make Jason masks cuz some other company has the rights?

You have the pay the license holder to have the right to make reproductions of anything that license is held over. More than one people can buy a license to produce an item from any particular movie, and the cost normally ranges on several different factors, a prominent one being popularity of the film in this case. I forget the dollar amount, but a while back Marvels asking price to produce a licensed hammer was almost $1 mil a year.

More than one party can hold the license to produce items from the film, but it just kind of depends. It’s likely that at some point TOTS will offer F13th stuff, but who knows.

I actually once got really curious about licensing for Halloween. I saw all these t-shirt companies coming out with stuff and thought I would look into it. So I found the company that would license Halloween. They are called the Creative Licensing Corporation. This was their response to me:

"Thank you for your inquiry. I apologize for my delayed response.

We can offer you a license for Halloween. There is a required minimum advance of $5000, which is paid on signing of the contract. The royalty is 12% and the term is usually two years. "

So you pay $5,000 upfront and then pay them 12% of all your sales for a period of two years.

Interesting… maybe you can purchase rights through a rights holder, not just Trancas? That would make sense how Ken was able to make an “arrangement” with Zephro to make his mask. Unless I’m wrong there, Z was never clear on what that arrangement was.

I think at least with my inquiry, it was specifically about apparel and prints. I think there are different tiers of licensing depending on what you you want to sell. I could be wrong, but that was my understanding at least.

I also see sometimes from other companies like NECA and the like , where they will show a prototype and say “pending licensor approval”.
So I would guess that even when buying rights you still have a process of getting designs approved. Again, I could be misunderstanding.

On a slightly unrelated note, I work for a family owned photo studio. We do school photos. A school wanted us to make photo backgrounds with NFL logos and such. So we looked into licensing for that. That by itself would of run 10 grand a year. haha

All in all, I learned that licensing out a property is just not for someone like me.

who's that handsome coverall wearing Michael at the bottom lol do most people make custom clothes for their stuff. I found a great part 4 Dr.Loomis 1/6 head, but since licensing I'd have to compile a Loomis from the ground up to get a Loomis figure.
