Yes, I would assume Universal would be able to control that aspect of it. TOTS would not be able to put out the masks with the chips on them unless they had them licensed as Halloween three specific masks from universal. Just like universal couldn’t put out a Halloween III product without licensing the mask use from Don Post (TOTS). My belief is that, from TOTS perspective, this is part of their investment in purchasing Don post that anyone who tries to put out Halloween III merch should also have to license the mask likeness from them too. In order for tots to not have to license say the skull or witch masks from Universal they would have to just put them out as Don posts, green witch and skull masks without any mention on the tags or branding of Halloween III. Tots would also be free to put out Vermilion and hagatha variants of the masks. Intellectual property law can be pretty complicated and I only have limited experience with it from my work history so this is mostly assumptions on my part.
